The <br />sixty day extension granted by the Board of County Commissioners as to alleged violation of county <br />regulations expires April 12, 1997. The purpose of this letter is to respond to Indian River County <br />directly as to the status of this matter and request an additional extension as warranted under the <br />circumstances herein. <br />On February 28, 1997 in response to the Florida Department of Environmental Protection <br />(FDEP) letter of February 21, 1997, the property owner requested of the FDEP a modification to <br />Permit IR -511. For the reasons expressed in that correspondence, the FDEP was <br />requested to modify <br />the existing permit which would result in the seawall as currently constructed determined in <br />compliance with state and local regulation. On April 2, 1997, as -built drawings for the steel sheet <br />pile bulkhead were forwarded to Sri Tammisatti of the FDEP. The property owners are compiling <br />the remaining documentation lequested in the FDEP letter of March 7,1997 from which the permit <br />modification will be reviewed by FDEP. A copy of the February 28,1997, March 7,1997 and April <br />2, 1997 letters are enclosed for your review. <br />Based on all relevant circumstances and in consideration of the equities in this matter since <br />the FDEP is reviewing the requested modification to Permit IR -511, it is respectfully requested that <br />an additional sixty days be granted during which time we sincerely hope that the FDEP completes <br />their review and that a resolution of this matter is final. <br />Thank you for the courtesies extended to date.
