M M M <br />Public Works Director James W. Davis gave a brief history of the permit and approval by the <br />State. He pointed out the stringent requirements of the State and Federal governments regarding turtle <br />nesting. <br />Commissioner Adams had no problem with extending the permit another 60 days. She hoped <br />DEP would get it resolved before that time elapsed as they were the ones who needed to decide where <br />the seawall is to go. <br />Chairman Eggert was fiustrated, but willing to wait for DEP to follow through. As far as she <br />was concerned, 60 days extension was the limit. <br />Both Commissioner Adams and Commissioner Ginn felt that it was the State's responsibility to <br />make a decision as to how this and the other seawalls should be placed. <br />Commissioner Gum wondered if the seawall configuration would cause scouring, she felt that <br />DEP needed to set policies. <br />Director Davis advised that the policy DEP communicated to staff is they consider a location <br />15 feet off the primary structure or the top of the b14 whichever is the most landward. <br />Commissioner Ginn enumerated problems that needed to be addressed at the State level to give <br />us some additional guidelines. <br />Director Davis added that the State did not consider a straight wall, with no deflection, to be <br />advantageous over one with angles and deflections. <br />Commissioner Ginn thought that if that was the State's policy, then the Board needed to <br />adhere very strictly to it. <br />Commissioner Adams stated it was an arbitrary decision because it hasn't been determined by <br />research and there has been evidence of problems with uneven seawalls. <br />Commissioner Gum suggested that perhaps Coastal Engineer Jeff Tabar might get one of his <br />Florida Institute of Technology PbD candidates to do a little research on it to see if they can get us an <br />answer on that. <br />ON MOTION by Commissioner Adams, SECONDED by <br />Commissioner Ginn, the Board unanimously (4-0, Commissioner <br />Macht being absent) granted a 60 day extension on the seawall permit <br />issued to Larry and Cheryl Gerstner. <br />83 <br />[iOJI ?
