CHAST <br />AND STAFFED MANAGER OF A E T PROJECTS <br />BY: DEPARTMENT OF TILITY SERVICES <br />SUBJECT: WEST MEADOWS SUBDIVISION PETITION WATER SERVICE <br />(45TH AVENUE AND 45TH COURT, NORTH OF 4TH STREET) <br />INDIAN RIVER COUNTY PROJECT NO. UW -97 -05 -DS <br />BACKGROUND <br />A petition has been received from the residents of West Meadows <br />Subdivision (45th Avenue and 45th Court, north of 4th Street) <br />requesting the County to supply potable water to its residents. We <br />are now coming to the Board of County Commissioners to seek <br />approval to begin design of the above-mentioned project. (See <br />attached petition and plat map.) <br />ANALYSIS <br />Of the subdivision's 28 lots (all .54 acres), one at the corner of <br />45th Avenue and 4th Street has been on County water since 1992 <br />without an agreement to be included in a future water assessment. <br />This lot is grandfathered in and will not be included. Of the 27 <br />lots to benefit from the assessment, 15 (56%) have signed the <br />petition supporting and agreeing to be included. On February 18, <br />1997, the attached letter was mailed to the remaining 12 owners, <br />together with an addendum to the petition (copy attached) stating, <br />"We wish to provide each owner the opportunity to -indicate his/her <br />support or opposition." To date only one objection has been <br />received. This was on February 20, 1997 by telephone. This person <br />stated that although he does not want County water, if the majority <br />do, he will not oppose it and will go along with the project. <br />The attached map displays the area to benefit from the assessment <br />project. This project is to be paid through the assessment of <br />property owners along the proposed water line route. In the <br />interim, financing will be from the assessment fund. Design <br />services will be provided by the Department of Utility Services. <br />The staff of the Department of Utility Services recommends approval <br />of the above -listed project and requests authorization for the <br />Department to proceed with the design engineering work in <br />preparation for the special assessment project. <br />ON MOTION by Commissioner Ginn, SECONDED by <br />Commissioner Macht, the Board, by a 4-0 vote <br />(Commissioner Tippin being absent) approved the project <br />and authorized staff to proceed with the design engineering <br />work in preparation for the special assessment project, as <br />recommended by staff. <br />MAY 6 1997 98 <br />
