ON MOTION by Commissioner Adams, SECONDED by <br />Commissioner Ginn, the Board unanimously adopted <br />Ordinance 97-16, as amended, amending the following <br />chapters of the Land Development Regulations (LDRs): <br />Chapter 901, Definitions; Chapter 911, Zoning; Chapter 912, <br />Single Family Development; Chapter 917, Accessory Uses <br />& Structures; Chapter 954, Off -Street Parking; Chapter 971, <br />Regulations for Speck Land Use Criteria; and providing for <br />repeal of conflicting provisions, codifications, severability <br />and effective date.. <br />ORDINANCE NO. 97- 16 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA AMENDING <br />THE FOLLOWING CHAPTERS OF THE LAND DEVELOPMENT <br />REGULATIONS (LDRS): CHAPTER 901, DEFINITIONS; CHAPTER <br />911, ZONING; CHAPTER 912, SINGLE FAMILY DEVELOPMENT; <br />CHAPTER 917, ACCESSORY USES & STRUCTURES; CHAPTER 954, <br />OFF-STREET PARKING; CHAPTER 971, REGULATIONS FOR <br />SPECIFIC LAND USE CRITERIA; AND PROVIDING FOR REPEAL OF <br />CONFLICTING PROVISIONS, CODIFICATIONS, SEVERABILITY AND <br />EFFECTIVE DATE. <br />BE IT ORDAINED by the Board of County Commissioners of <br />Indian River County, Florida that the Indian River County land <br />development regulations (LDRs) be amended as follows: <br />PART 1. <br />A. Amend the definition of "Transmission tower" in section <br />901.03, to read as follows: <br />Communications tower: r1':t3C <br />a gtzet;. pottzC:..iahterta;; a structure used for the <br />primary purpose of supporting one or more antennas, and <br />related attachments such as safety lighting and lightni <br />rods. The following shall be considered not to be a <br />"communications tower": <br />a structure supporting a utility transmission line(s) <br />only, <br />a structure up to 150' high supporting a 69 KV or <br />higher voltage utility transmission line(s) and an <br />antenna(s), when located in non-residential zoning <br />districts. <br />Note: Notwithstanding anything in section 971.44(1) to the <br />contrary, within residential zoning districts no <br />telecommunications additions (such as antennas or support <br />structures) shall be made to utility poles that would result <br />in an increased height of the pole and its attachments. <br />Certain types of communications towers are defined as <br />follows: <br />(a) Amateur Radio: a tower structure used by an individual <br />or individuals licensed by the Federal Communications <br />Commission as an amateur radio operator(s) and where <br />such use is covered by the Federal Communications <br />Commission PRB-1 preemption. <br />MAY 69 1997 55 PACE 338 <br />
