4. Design of a climate control system for the laboratory and <br />instrumentation and control building. The existing window air <br />conditioning system is inadequate for this sensitive <br />electronic monitoring and control instrumentation. This is <br />needed to protect the County's investment. <br />Additional permitting and design services. FDEP, during its <br />completion of the environmental resource permit, requires our <br />County to mitigate the impacted onsite wetland with similar acreage <br />creation in proportion to the size of the wetland. <br />These additional services were recently proposed based upon the <br />exact cost of spending. Staff has negotiated reasonable and fair <br />compensation in the amount of $27,206.00 for Items 1 through 4, and <br />$31,906.00 for additional design and permitting services, for a <br />total of $59,112.00. This will increase the total contract to <br />$581,613.00. <br />RECOMMENDATION <br />The staff of the Department of Utility Services recommends approval <br />of Addendum No. 3 to the contract with Camp Dresser and McKee, Inc. <br />in the amount of $59,112.00 for the additional services and <br />authorization of the chairman to execute same. <br />ON MOTION by Commissioner Ginn, SECONDED by <br />Commissioner Adams, the Board (40, Commissioner Tippin <br />being absent) unanimously tabled this item for 2 weeks. <br />12. BLAKE-TORRES I[MGATION - OFFER OF JUDGMENT <br />The Board reviewed a Memorandum of May 13, 1997: <br />TO: The Board of County Commissioners <br />FROM: Terrence P. O'Brien - Assistant County Attomeyc��o <br />DATE: May 13, 1997 <br />SUBJECT: Offer of Judgment - Blake -Torres Litigation <br />The County has been sued for a count in inverse condemnation by Blake -Tones, <br />owners of property at Oslo and Old Dixie formerly owned by Helseth. <br />The gist of the complaint is that the County, in making the improvements, has <br />encroached into Blake -Tones property and has cut off access to the garage and <br />several other allegations of damage. The County has always stood ready to, in <br />effect, make them whole; however, they have not cooperated and appear to <br />prefer litigation. <br />Engineering has calculated the total cost to correct everything that is County's <br />responsibility at $; � ) a • -' In order to establish a bench mark for damages, it <br />is recommended that an offer of judgment in the amount of $_-*' be <br />authorized. <br />" These figures will be provided at the Commission meeting. It is estimated <br />that the amounts will be less than $25,000. <br />Assistant County Attorney Terrence P.
