It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at its regular <br />meeting of May 27, 1997. <br />Mr. & Mrs. Dodson have submitted a request to divide Lot F in the <br />Hidden Acres Subdivision into two lots, one of which would be the <br />smallest lot in the subdivision. Pursuant to the provisions of <br />Chapter 913 governing the subdivision of land, the division of a <br />platted lot that results in the creation of a lot having less <br />square foot area than the smallest approved lot in the subdivision <br />must be reviewed by the Planning and Zoning Commission and approved <br />by the Board of County Commissioners. <br />At its regular scheduled meeting of May 8, 1997, the Planning and <br />Zoning Commission voted unanimously to recommend that the Board of <br />County Commissioners grant the subject request with the conditions <br />stated in the recommendation section of this report. The Board of <br />County Commissioners is now to consider the potential impact of the <br />proposed lot split upon the subdivision (neighborhood) as outlined <br />in section 913.06(1)(F) (see attachment #5). After considering the <br />recommendation from the Planning and Zoning Commission, the Board <br />may either approve, approve with conditions, or deny the subject <br />request. The Board may attach to its recommendation any reasonable <br />condition(s) which it feels necessary to mitigate possible negative <br />impacts. <br />AN 7 Y=: <br />Hidden Acres was originally platted as 8 one acre lots. In the <br />late 1980s, the Board of County Commissioners approved a proposal <br />to allow each lot in the Hidden Acres Subdivision to be split one <br />time into two lots of approximately equal size, resulting in i acre <br />lots. That Board decision was based upon the appropriateness of <br />allowing } acre lots throughout the subdivision. Subsequent to the <br />Board determination, Lots A, B, C, and H were legally split into <br />two lots each, thus establishing 11 buildable lots. Currently the <br />smallest lot within the Hidden Acres Subdivision is 21,375 square <br />feet. The proposed lot (F) split will result in the creation of a <br />30,000 square foot lot and a 15,000 square foot lot. The 30,000 <br />square foot lot needs to be larger than half an acre (21,780 square <br />feet) to accommodate sufficient setbacks for the existing house on <br />Lot F. The remainder of Lot F will result in the 15,000 square <br />foot lot, which will measure 100' X 1501. <br />In order to minimize the impact of creating the smallest lot in the <br />subdivision, the applicant has proposed the following minimum <br />building setbacks: <br />Proposed: Required for RS -6 Zoning: <br />North: <br />25' <br />North: <br />10' <br />South: <br />10' <br />South: <br />10' <br />East: <br />40' <br />East: <br />20' <br />West: <br />30' <br />West: <br />20' <br />These proposed building setbacks will provide for increased <br />separation distances between residences and would be consistent <br />with existing building separation distances in the subdivision. <br />The location of the proposed lot line dividing Lot F, in <br />conjunction with the special setbacks listed above, would establish <br />a building separation distance of 65' between the existing <br />residence on the northern portion of Lot F and the future residence <br />on the newly created lot (see attachment #4). Because of the <br />proposed 10' building setback on the south property line, in <br />conjunction with a platted 35' easement that exists on the adjacent <br />lot (Lot G), building separation to the south of the subject lot is <br />guaranteed to be at, least 451. Staff supports the proposed lot <br />split with the special building setbacks proposed, provided that <br />deed restrictions are established to ensure that the proposed <br />building setbacks are binding and run with the land. <br />18 <br />MAY 27,1997 <br />� s r <br />
