Ke t n AICViector <br />Community Develop nt <br />THROUGH: <br />Stan Boling, AICP <br />Planning Director <br />FROM: <br />Eric Blad �% <br />Staff Planner, Current Development <br />DATE: <br />June 11, 1997 <br />SUBJECT: Glendale Acres Inc.'s Request for Final Plat Approval for <br />a Private Road Right -of -Way (88th Court Private Cul -de - <br />Sac) <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at its regular <br />meeting of June 17, 1997. <br />DESCRIPTION AND CONDITIONS: <br />On March 27, 1997, the Planning and Zoning Commission approved the <br />proposed preliminary plat to establish a private, unpaved road <br />right-of-way to be known as 88th Court. The subject roadway will <br />be a private cul-de-sac segment located on the north side of 8th <br />Street approximately 900' east of 90th Avenue. The applicant has <br />also submitted an affidavit of exemption request to create seven 5 <br />acre parcels, four of which will have direct access to the proposed <br />88th Court right-of-way (see attachment W. Affidavits of <br />exemption, which are approved at a staff level, allow the creation <br />of parcels containing at least 200,000 square feet, without <br />platting lots and constructing formal subdivision improvements. <br />Prior to staff approval of the applicant's affidavit of exemption <br />request, final plat approval must be granted for a private road <br />right-of-way to create legal road frontage for each proposed lot. <br />The applicant has now submitted for final plat approval for the <br />88th Court private road right-of-way. <br />ANALYSIS: <br />The County's land development regulations allow for the platting of <br />unimproved private road right-of-way if such right-of-way is not <br />serving a formal subdivision. Such is the case with this request. <br />Under these provisions, the proposed road is exempt from normal <br />road and drainage improvements, but must satisfy county standards <br />in regard to access, alignment, dimensional requirements and <br />environmental issues. Since no physical subdivision improvements <br />are required, and none are proposed, a land development permit was <br />not required. The proposed final plat is consistent with the <br />approved preliminary plat, and satisfies applicable regulations for <br />creation of a private road right-of-way. <br />JUNE 179 1997 <br />0 <br />
