of platted conservation easements. The original developer, Stolle Development <br />Corporation, placed approximately 3-1/2 acres of contiguous property which they <br />owned south of 13th Street, S.W. and west of 27th Avenue under a conservation <br />easement. The conservation easements within Lindsey Lanes Phase I <br />Subdivision were at times precluding the development of accessory uses such <br />as swimming pools on certain lots. Since the approval of the "land bank" by the <br />County Commission and recordation of the Conservation Easement at O.R. <br />Book 1030, Page 428, Public Records of Indian River County on August 11, <br />1994, the Board has approved individual releases on eight lots. <br />A successor developer, Art Garcia, has recently sold Lot 18, Block A of Lindsey <br />Lanes Phase I Subdivision and the owner cannot install a pool without a release <br />of the conservation easement. Mr. Garcia proposes and staff concurs that rather <br />than come to the Commission with individual releases, which is a very time- <br />consuming matter, that a number of lots have easements released at once. The <br />proposal before the Board would release the conservation easement from nine <br />lots, i.e., a total of 16,382 square feet plus or minus. The unutilized square <br />footage in the land bank area stands at approximately 140,000 square feet at <br />this time. Thus the remaining acreage in the land bank covered by a <br />conservation easement would be on the order of 123,618 square feet or 2.84 <br />acres. <br />RECOMMENDATION <br />Authorize the Chairman to execute the attached Release and Substitution of <br />Conservation Easements for Lots 1, 2, 3, 13 and 18 of Block A; Lot 3 of Block B; <br />Lots 2 and 4 of Block C; and Lot 3 of Block F. <br />ON MOTION by Commissioner Adams, SECONDED by <br />Commissioner Ginn, the Board unanimously approved the <br />Release and Substitution of Conservation Easements for Lots <br />1, 2, 3, 13 and 18 of Block A; Lot 3 of Block B; Lots 2 and 4 <br />of Block C; and Lot 3 of Block F and authorized the Chairman <br />to execute the Release, as recommended by staff. <br />EASEMENT IS RECORDED IN THE OFFICIAL <br />RECORDS OF INDIAN RIVER COUNTY <br />9.A.1 PUBLIC HEARING - O'BRIEN VS INDIAN RIVER COUNTY <br />- SETTLEMENT <br />JUNE 179 1997 <br />19 <br />El 00 vU L PAGE 7178 <br />
