DeBlois'VWI-CP <br />Chief, Environmental Planning <br />& Code Enforcement <br />DATE: July 1, 1997 <br />SUBJECT: Public Nuisance Abatement and Assessment; County Removal <br />of Dead Pines from Property at 1595 22'0 Ave SW Owned by <br />Giovanni Pacifico <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at its regular <br />meeting of July 8, 1997. <br />D .RCRTPTTQK AND CQNDTTTQKS <br />On April 25, 1997, code enforcement staff sent a Notice of Public <br />Nuisance to Giovanni Pacifico, concerning several hazardous dead <br />pine trees on his property at 1595 22nd Avenue SW in the Oslo Park <br />Subdivision. In accordance with County Code Section 973.09, the <br />subject property was posted (on April 25, 1997) to serve as legal <br />notice. <br />The Respondent was cited as maintaining his property in violation <br />of County Code Section 973.03, which deems dead trees posing a <br />health or safety hazard as a public nuisance. A neighboring house <br />was within the fall radius of the subject dead trees. <br />Mr. Pacifico resides in Venezuela. When he learned of the public <br />nuisance, Mr. Pacifico contacted county code enforcement staff by <br />phone. Staff advised Mr. Pacifico that he needed to arrange for <br />removal of the dead pine trees, or the County would remove the <br />trees and charge him the cost, including a $75 administrative fee. <br />Mr. Pacifico indicated that, given the circumstances, the most <br />effective action would be for the County to remove the trees, and <br />then he would pay the County for the cost. <br />Subsequently, in accordance with Chapter 973.04(2) of the County <br />Code, county personnel (ie: Road and Bridge Division staff) abated <br />the nuisance violation, with the cost to be assessed against the <br />property owner. <br />25 <br />JULY 89 1997 <br />i <br />BOOK 0?
