BOOK IN FAKE 32. <br />Chapter 973.06(1) of the County Code requires that the cost of a <br />county nuisance abatement shall be calculated and reported to the <br />Board which, by resolution, shall assess such costs against the <br />property. This matter is now presented to the Board for <br />consideration of adopting said resolution. <br />Section 973.06 of the County Public Nuisance Ordinance specifically <br />reads as follows: <br />"After abatement of the nuisance by the county, the cost thereof to the <br />county as to each lot, parcel or tract of land shall be calculated and <br />reported to the board of county commissioners. Thereupon, the board of <br />county commissioners, by resolution, shall assess such costs against such <br />lot, parcel or tract of land. such resolution shall describe the land and <br />state the cost of abatement, which shall include an administrative cost of <br />seventy-five dollars ($75.00) per lot. Such assessment shall be a legal, <br />valid and binding obligation upon the property against which made until paid. <br />The assessment shall be due and payable thirty (30) days after the mailing of <br />the notice of assessment after which interest shall accrue at the rate of <br />twelve (12) per cent per annum on any unpaid portion thereof." <br />Costs for equipment use, labor, and landfill charges, as indicated <br />by the Road and Bridge Division ( see attached) , plus the $75.00 <br />administrative fee calculate to be: <br />Equipment: 4.61 <br />Labor: 25.90 <br />Landfill Charges: N/A (felled trees left on the wooded lot) <br />Administrative fee: 75.00 <br />TOTAL: $105.51 <br />Staff recommends that the Board of County Commissioners adopt the <br />attached resolution assessing $105.51 in nuisance abatement costs, <br />in accordance with Chapter 973.06, Public Nuisance, of the Code of <br />Laws and Ordinances of Indian River County. <br />1. Memo from Road & Bridge staff summarizing abatement costs <br />MOTION WAS MADE by Commissioner Macht, SECONDED BY <br />Commissioner Adams, to approve staffs recommendation <br />Chairman Eggert wanted the following added to the resolution: "since he [owner] was <br />out of the country" because the owner had tried to do something about the dead pines.
