McCoy, AICP �W <br />Senior Planner, Current Development <br />DATE: July 10, 1997 <br />SUBJECT: Marquis Corp.'s Request for an Abandonment of a Portion <br />of 94th Avenue <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at its regular <br />meeting of July 22, 1997. <br />The Marquis Corp. has submitted a petition for the abandonment of <br />94th Avenue adjacent to Lots 4 and 5, Block A, Vero Tropical Garden <br />Unit 1. This portion of 94th Avenue is located at the northwest <br />corner of the I-95/SR 60 interchange and dead -ends in the right-of- <br />way for I-95 (see attachment #2). The portion of the right-of-way <br />proposed for abandonment is roughly triangular in shape. <br />The applicant is requesting that this portion of right-of-way be <br />abandoned, since the right-of-way will not be used for roadway <br />purposes. If abandoned, the right-of-way area will be added to <br />adjacent commercially zoned property owned by the applicant and <br />will become developable commercial property. The Board is now to <br />consider the abandonment request. <br />ANAT.V Q T, <br />The existing 70' wide 94th Avenue right-of-way was created via the <br />1957 plat of Vero Tropical Gardens. Subsequently, I-95 was <br />constructed over part of Vero Tropical Gardens and truncated the <br />right-of-way for 94th Avenue at an angle, forming a triangular <br />shaped piece of right-of-way with a notched base (see attachment <br />#3). Based on the shape of the right-of-way and the fact that it <br />dead -ends into I-95 right-of-way, staff's position is that the <br />subject segment of 94th Avenue is not useable as road right-of-way <br />and does not fulfill the intention for which it was originally <br />platted. <br />According to the County Attorney's Office, any platted right-of-way <br />that the county abandons is conveyed to adjacent property owners. <br />In this instance, the small portion east of the centerline would go <br />to the FDOT if the county abandons its interest. The applicant <br />could then pursue acquisition of such land from the FDOT. <br />22 <br />JULY 22, 1997 <br />r � � <br />
