While the right-of-way is not useable to the county for road <br />building purposes, it could still be used for future drainage and <br />utility purposes. Therefore, the county engineering division is <br />recommending that a drainage and utility easement be retained over <br />the abandoned right-of-way. For that reason, the Resolution of <br />Abandonment expressly reserves a drainage and utility easement. <br />Per guidelines established by the Board of County Commissioners, <br />this petition was reviewed by all county divisions and utility <br />providers having jurisdiction or potential interests within the <br />right-of-way. All reviewing agencies and departments have <br />recommended approval of the requested abandonment, with the <br />condition that an easement for utilities and drainage be reserved <br />over the abandoned area. The subject right-of-way is not part of <br />the roadway system as noted on the County Thoroughfare Plan, and is <br />not needed for the thoroughfare system. Furthermore, the <br />abandonment would not affect the right of convenient access to the <br />subject property or to surrounding properties. Also, the County <br />Attorney's Office has reviewed and approved the attached <br />abandonment resolution for legal form and sufficiency. <br />E:; • Uiut X 191.11 th • � <br />Based on the analysis, staff recommends that the Board of County <br />Commissioners abandon its rights to the subject right-of-way and <br />authorize the chairman to execute the attached abandonment <br />resolution, with the following condition: <br />1. That the entire right-of-way be reserved as a drainage and <br />utility easement. <br />Chairman Eggert asked if there were any questions; there were none. She then opened <br />the public hearing and asked if anyone wished to be heard in this matter. <br />Jack Ketter, President of Marquis Corporation, advised the reason for making this <br />application for abandonment is to make a neater piece of property. Although it probably will <br />never be built on, they may put it to some use in the future such as a sign for the commercial <br />property they own. <br />It was determined that no one else wished to be heard and the Chairman closed the public <br />hearing. <br />ON MOTION by Commissioner Adams, SECONDED BY <br />Commissioner Macht, the Board unanimously adopted Resolution <br />No. 97-70 providing for the closing, abandonment, vacation and <br />discontinuance of a portion of 90 Avenue adjacent to Lots 4 & 5, <br />Block A, Vero Tropical Gardens, Unit 1, and reserving a drainage <br />and utility easement over the abandoned right-of-way said land <br />lying in Indian River County. <br />23 <br />JULY 229 1997 E u � ,` `E _u <br />
