ON MOTION by Commissioner Tippin, SECONDED by <br />Commissioner Ginn, the Board, by a 4-0 vote (Commissioner <br />Macht absent) unanimously adopted Resolution 97-116 to the <br />Constitutional Revision Commission of the State of Florida in <br />support of a constitutional revision prohibiting unfunded state <br />mandates without a super -majority vote of the Legislature. <br />RESOLUTION NO. 97-116 <br />A RESOLUTION OF INDIAN RIVER COUNTY, FLORIDA, <br />TO THE CONSTITUTIONAL REVISION COMMISSION OF <br />THE STATE OF FLORIDA IN SUPPORT OF A <br />CONSTITUTIONAL REVISION PROHIBITING UNFUNDED <br />STATE MANDATES WITHOUT A SUPER -MAJORITY <br />VOTE OF THE LEGISLATURE. <br />WHEREAS, the Constitutional Revision Commission has invited comments from local <br />governments and the public about ways to improve the Florida Constitution; and <br />WHEREAS, Indian River County is concerned with the Legislature's ability to issue <br />unfunded mandates to local governments since local governments should control their <br />spending decisions; and <br />WHEREAS, Indian River County would like it to be constitutionally required that any <br />state mandate be passed by a super -majority vote of the Legislature, and not by a simple - <br />majority vote as it is now; and <br />WHEREAS, Indian River County feels that this constitutional revision is necessary to <br />protect its citizens and taxpayers; <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, that the Board urges the <br />Constitutional Revision Commission to recommend that it be added to the state constitution that <br />unfunded state mandates are prohibited unless passed by a super -majority vote. <br />The resolution was moved for adoption by Commissioner Tippin, and the motion was <br />seconded by Commissioner Ginn, and, upon being put to a vote, the vote was as follows: <br />Chairman Carolyn K. Eggert <br />Aye <br />Vice Chairman John W. Tippin <br />Aye <br />Commissioner Kenneth R. Macht <br />Absent <br />Commissioner Caroline D. Ginn <br />Aye <br />Commissioner Fran B.
