The reason we raise this issue is that there are two widows on <br />fixed incomes among the property owners who would find it difficult to supply their share <br />of a $10,000 cash bond at such short notice. <br />3. With respect to the penalty clause, we request that it be amended so that any <br />penalties would apply after April 1, 1998 if the park is still being used. The homeowners, <br />to protect themselves, will include these penalties in our contract with the contractor. The <br />penalties as they exist at present presumed a start date of November 1, 1997. The <br />contractor requires the homeowners to provide access to the beach and therefore we are <br />in violation of our contract with him and therefore it is in everyone's best interest to <br />resolve this problem as soon as possible as we all know time is of the essence due to the <br />turtle nesting season. As for the daily penalty, there absolutely must be a provision for <br />inclement weather to be determined by the contractor and Mr. Bruno. <br />4. Mr. Vitunac stated that it would be easier for the county to deal with a single <br />homeowner representing all eight homeowners as we do not have a Homeowner's <br />Association. Mr. Vince Bruno, who represents Dr. Richard Simpson of 9480 Doubloon <br />Drive, has volunteered to represent the homeowners for the agreement. <br />S.
