ON MOTION by Commissioner Adams, SECONDED BY <br />Commissioner Macht, the Board unanimously approved the <br />PD rezoning and Ordinance No. 97-28 and conceptual plan <br />with the conditions set out in the Memorandum and <br />presentation by staff.. <br />ORDINANCE NO. 97- a <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING <br />THE ZONING ORDINANCE ON THE ACCOMPANYING ZONING MAP <br />FROM CL TO PD FOR THE PROPERTY LOCATED ON THE NORTH SIDE <br />OF SR 60 IN THE 8400 BLOCK APPROXIMATELY 650' EAST OF 85TH <br />COURT AND DESCRIBED HEREIN AND PROVIDING FOR EFFECTIVE <br />DATE. <br />WHEREAS, on November 13, 1997 the Planning and Zoning Commission, sitting as the <br />local planning agency on such matters, has held a public hearing and subsequently made a <br />recommendation regarding this rezoning request; and <br />WHEREAS, the Board of County Commissioners of Indian River County, Florida, did <br />publish its Notice of Intent to rezone the hereinafter described property, and <br />WHEREAS, the Board of County Commissioners has determined that this rezoning is in <br />conformance with the Comprehensive Plan of Indian River County; and <br />WHEREAS, the Board of County Commissioners has held a public hearing pursuant to <br />this rezoning request, at which parties in L ierest and citizens were heard; <br />NOW, THEREFORE, BE IT ORDAINED, by the Board of County Commissioners of <br />Indian River County, Florida, that the zoning of the following descnbed property situated in <br />Indian River County, Florida to -wit: <br />LEGAL DESCRIPTION <br />COMMENCING AT THE SOUTHEAST CORNER OF TRACT 7, SECTION 2, <br />TOWNSHIP 33 SOUTH, RANGE 38 EAST, ACCORDING TO THE LAST <br />GENERAL PLAT OF LANDS OF THE INDIAN RIVER FARMS COMPANY, <br />FILED IN PLAT BOOK 2, PAGE 25, PUBLIC RECORDS OF ST. LUCIE <br />COUNTY, FLORIDA, SAID LANDS LYING AND BEING IN INDIAN RIVER <br />COUNTY, FLORIDA; THENCE RUN NORTH 00°00'43" WEST ALONG THE <br />EAST LINE OF SAID TRACT 7 A DISTANCE OF 147.65 FEET TO THE <br />NORTH RIGHT-OF-WAY OF STATE ROAD 60 AND POINT OF <br />BEGINNING, THENCE CONTINUE NORTH 00°0043" WEST A DISTANCE <br />OF 623.24 FEET; THENCE RUN SOUTH 89059'17" WEST A DISTANCE OF <br />324.64 FEET; THEN RUN SOUTH 00°00'43" EAST A DISTANCE OF 623.12 <br />FEET TO SAID NORTH RIGHT-OF-WAY; THENCE RUN 89°5927" EAST <br />ALONG SAID NORTH RIGHT-OF-WAY A DISTANCE OF 324.64 FEET <br />THE POINT OF BEGINNING. <br />Be changed from CL to PD. <br />All with meaning and intent as set forth and described in said land development <br />regulations, and the attached conceptual plan. <br />33 <br />December 9, 1997 <br />11COX <br />
