LOST TREE VILLAGE CORPORATION - ACCEPTANCE <br />OF DONATED PROPERTY <br />The Board reviewed a Memorandum of October 1, 1997: <br />TO: The Board of County Commissioners <br />FROM: uYl William G. Collins II - Deputy County Attorney <br />DATE: October 1, 1997 <br />SUBJECT: Acceptance of Property Donated by Lost Tree Village Corporation <br />On May 20, 1997 the Board entertained a request for County acceptance of road <br />right-of-way and conservation land from Lost Tree Village Corporation as partial <br />mitigation for the development of two single-family residences on Wabasso <br />Island. The Board authorized staff to take the necessary actions for the County <br />to obtain legally sufficient title to the described property. <br />Since that time, representatives of Lost Tree Village Corporation have presented <br />a right-of-way deed from 1952 from Elizabeth Hansen to the Board of County <br />Commissioners. The deed describes 100 -foot wide right-of-way around a <br />centerline running south from Wabasso Bridge to Pine Island. This right-of-way <br />bisects the two upland parcels on which Lost Tree Village wishes to construct <br />the single-family residences. Lost Tree has asked that the County acknowledge <br />that the deed as to their property is null and void under its own terms because a <br />public road was not constructed on that portion of the right-of-way, and that land <br />within the unutilized right-of-way reverted to Lost Tree Village Corporation as the <br />assignee of Elizabeth Hansen. <br />Because the centerline of the right-of-way and the existing Live Oak Drive <br />pavement appear to converge north of the Lost Tree Village Corporation <br />property, it is proposed that only that portion of the right-of-way in the 1952 deed <br />within the Lost Tree Village Corporation parcel be acknowledged as having <br />reverted under the terms of the 1952 deed. <br />A resolution has been prepared which accepts the dedication by Lost Tree <br />Village Corporation of a 1.45 -acre piece of land for a conservation area to be <br />added to the lease of the Environmental Learning Center, as well as .96 acres <br />which is a 60 -foot overlay of the existing Live Oak Drive right-of-way within the <br />Lost Tree Village Corporation properties. The resolution also acknowledges that <br />DECEMBER 23, 1997 <br />-23- PAGE' <br />. <br />
