Collins II - Deputy County Attorney <br />DATE: February 18, 1998 <br />SUBJECT: Contract For Construction of Required Utility Improvements - Lots <br />6 -10, Plat of Home Depot At Vero Beach <br />The plat of Home -Depot At Vero Beach covers property not only owned by Home <br />Depot, but six platted lots to the south of proposed College Lane owned by <br />Sidney M. Banack Jr. By plat Mr. Banack has provided for utility easements to <br />each lot. However he wishes to defer construction of the utility improvements by <br />entering into a contract to construct the required improvements within one year <br />of final plat approval and posting of security in the form of a performance bond. <br />This is allowed under Code Section 913.10(1). <br />March 3, 1998 <br />18 <br />0 4b <br />
