0 <br />• <br />The delay in construction is because at this point Mr. Banack does not know <br />whether he will sell each lot to a separate buyer or perhaps one buyer will <br />purchase one or more of the lots. The ultimate configuration of the development <br />may have an impact on the need for utility extensions. <br />No development on lots 6 - 10 could be C.O.'d until such time as College Lane <br />construction has been completed by the County. If completion of College Lane <br />construction does not occur prior to the expiration date on the attached contract <br />(1/19/99), then we anticipate that Mr. Banack will apply for an extension of time <br />for performance of the contract, consistent with the provisions of Section <br />913.10(1)(E) of the Indian River County Code. <br />RECOMMENDATION <br />Authorize the Chairman to sign the attached Contract For Construction of <br />Required Utility Improvements and accept the security provided. <br />ON MOTION by Commissioner Ginn, SECONDED BY <br />Commissioner Eggert, the Board unanimously (4-0 Vice <br />Chairman Macht absent) authorized the Chairman to sign the <br />Contract for Construction of Required Utility Improvements <br />and accepted the security provided, as recommended in the <br />Memorandum. <br />COPY OF CONTRACT ON FILE <br />IN THE OFFICE OF THE CLERK TO THE BOARD <br />7.H.
