BREEZY VILLAGE WATER PLANT SITE - DISPOSAL <br />OF BREEZY VILLAGE HOME SUBDIVISION UNIT 1 <br />TRACTS A AND C <br />The Board reviewed a Memorandum of February 24, 1998: <br />DATE: FEBRUARY 24, 1998 <br />TO: JAMES E. CHANDLER <br />COUNTY ADMINISTRATOR <br />FROM: DONALD R. HUBBS, P.E. 1 <br />DIRECTOR OF UTILITY SE VIOLS 14 <br />PREPARED AND GENE A. RAUTH AA - <br />STAFFED BY: MANAGER OF WATERIWASTEWATER OPERATIONS <br />SUBJECT: DISPOSAL OF BREEZY VILLAGE WATER PLANT <br />SITE (BREEZY VILLAGE HOME SUB UNIT 1 <br />TRACTS A & C, PBI:9-34) <br />BACKGROUND <br />On March 1, 1989 Indian River County purchased Breezy Vnllage Water and Sewer <br />Utilities from Breezy Village Sewer and Water Company, Inc. (See attached contract for <br />sale and purchase). This purchase was part of the North County Sewer Transmission <br />Mains and Regional Wastewater Treatment Facility Project. <br />At the time of purchase, 92 customers of Breezy Village Sewer and Water Company, Inc., <br />were assessed a surcharge in the amount of $706.52 per customer to recover purchase <br />costs so as not to have a financial burden on the entire utility base. <br />Since the time of the purchase, the customer base associated with this system has been <br />consolidated into the County's main utility system <br />ANALYSIS <br />The Department of Utility Services is now prepared to dispose of both Tracts A and C <br />(previous plant sites). Tract B is owned by Breezy Village Homeowners Association (See <br />map attached). <br />With reference to Tract C, under the terms of the contract for sale and purchase. <br />Paragraph 7; "Right of repurchase as to Tract C" (See attached) there are specific <br />conditional requirements that must be met to the previous owner of this property. Under <br />the terms of this agreement this condition of 90 days notice without the previous owner <br />repurchasing it back has been met. (See attached letter dated July 7, 1997). With regards <br />to tract A. no specific reference is made to dispose of this tract within the contract of sale <br />and purchase. <br />A preliminary evaluation analysis of Tracts A and C is attached. Tract A is within the <br />range of $6,429.00 to $7,144.00 ($19,600.00 to $21,780.00 per acre). Tract C is within <br />the range of $18,819.00 to $22,583.00 ($10,890.00 to $13,069.00, per acre). <br />The Staff of the Department of Utility Services has received an inquiry from the Breezy <br />Village Homeowners Association as to the disposition of both tracts of property. <br />MARCH 10, 1998 <br />-73- 1 <br />L <br />
