Sell both Tracts A and C to the Breezy Village Homeowners Association for a <br />nominal price. <br />3. Sell Tract A to Breezy Village for a nominal price and surplus Tract C at a public <br />auction. <br />RECOMMENDATION <br />The Staff of the Department of Utility Services recommends option number three (3); Sell <br />Tract A to Breezy Village for a nominal price and surplus Tract C at a public auction. <br />The Department requests direction from the Board of County Commissioners with regards <br />to this matter. <br />MOTION WAS MADE by Commissioner Eggert <br />that the Board sell Tract A to Breezy Village for a <br />nominal price and surplus Tract C at a public <br />auction, as recommended by staff. <br />Under discussion, the Chairman recognized Eric D. Pollard from the audience. <br />Eric D. Pollard, 6153 98'b Place, Sebastian, lives at Breezy Village. He reminded the <br />Board that they had problems with their water plants and the County agreed to buy the plants <br />if the residents put up the funds. They each paid $706.52 and the County operated the plants <br />for a short time. Each resident had previously paid the developer $750 each for these plants. <br />Thereafter, when the residents bought the property, a second impact fee of $1,250.00 each <br />was paid to the County when the North County sewer line was installed. The residents feel <br />that Tracts A and C have been paid for twice. <br />Mr. Pollard continued that the previous Director of Utilities had told them they would <br />get the water plant property and the developer would have the right of first refusal on the <br />sewer plant property. The residents are requesting that these properties revert back to Breezy <br />Village Association, Inc., a non-profit corporation set up in 1986. <br />Commissioner Adams clarified that Tract A is the water plant and Tract C is the sewer <br />plant. She then questioned whether the amounts paid by the residents included the properties <br />or just the plants, and County Administrator Jim Chandler believed it included the entire <br />amount of land and the facility. <br />MARCH 10, 1998 <br />0 -74- <br />• <br />
