Administrator Chandler advised that the Claims Committee did meet and go through <br />all of the facts and unanimously recommended to proceed to trial as scheduled. If necessary, <br />all the exhibits and facts could be presented today for their consideration. <br />Commissioner Adams felt that if the Board wished to be judge and jury, there should <br />be a special meeting for it. <br />Chairman Tippin did not feel comfortable with having to hear this, and <br />Commissioners Macht and Eggert agreed. <br />Attorney Vocelle understood their concerns, but was asking that they make a business <br />decision. <br />Commissioner Ginn inquired about timing of the certification of the bargaining unit, <br />and Administrator Chandler advised that a vote to join the Teamsters union had occurred on <br />August 5, 1994. <br />Vice Chairman Macht thought that the best interest of all the parties involved would <br />be a clear representation in court before the judge. <br />ON MOTION by Commissioner Macht, SECONDED BY <br />Commissioner Adams, the Board unanimously agreed to take no <br />action and proceed to court in this matter. <br />9.B.
