Household pet definition and non-commercial kennels (staff and Planning and Zoning <br />Commission -initiated). <br />9. Mailed notice requirements: regular mail vs. certified mail (staff -initiated). <br />10. Recreational vehicle park occupancy time period and allowance for attaching carports and <br />porches (Sunshine Travel Park/Bruce Barkett, attorney). <br />The Planning and Zoning Commission (PZC) and the Professional Services Advisory Committee <br />(PSAC) have reviewed or are scheduled to review each proposed amendment. To proceed with the <br />review and approval process for the amendments, the Board must now set dates and times for its <br />required public hearings. <br />Planning staff has coordinated closely with the county attorney's office concerning state <br />requirements for LDR amendment hearings. The new legislation divides LDR amendments into two <br />types: <br />1. Amendments which change the actual list of permitted, conditional, or prohibited uses within <br />a zoning category (district); and <br />2. All other types of amendments. <br />One of the proposed amendments would change the list of uses allowed in certain zoning districts. <br />That amendment requires two hearings. Florida statutes provides that one hearing be held after 5:00 <br />p.m., while the other hearing may be held before 5:00 p.m. (e.g. regular Board meeting time). <br />However, the statutes also state that, with 4 or 5 positive votes, the Board could vote to hold both <br />LDR hearings before 5:00 p.m., such as at a regular Tuesday morning Board meeting. <br />Even though only one of the ten proposed LDR amendments requires two hearings, it is staffs <br />opinion that all of the LDR amendments should be considered at two hearings. It is also staffs <br />opinion that the first hearing should be held after 5:00 p.m. to better accommodate public input, and <br />that the second hearing, which is generally shorter and more of a "wrap-up" meeting, should be held <br />during a regular Tuesday morning Board meeting. <br />One set of hearing dates which would comply with state hearing and advertising requirements and <br />would allow for two hearings for all proposed amendments is as follows: <br />Holing D.= U= <br />Meeting #1 Special meeting Monday, May 4, 1998 5:01 P.M. <br />Meeting #2 Regular meeting Tuesday, May 19, 1998 9:05 am. <br />Staff has tentatively reserved use of the Commission Chambers for these proposed dates. The Board <br />may establish any other dates that meet state requirements and during which the Chambers may be <br />used. <br />Staff recommends that the Board concur with the proposed hearing dates or set other hearing dates <br />to consider the proposed LDR amendments. <br />APRIL 21, 1998 <br />#& 0 <br />
