PUBLIC NOTICE ITEM - ADOPTION OF LATEST EDITION <br />OF NATIONAL ELECTRICAL CODE MQ - PUBLIC <br />HEARING FOR MAY 12. 1998 <br />The Chairman announced that on May 12, 1998 a public hearing will be held <br />regarding the adoption of the latest edition of the National Electrical Code (NEC). <br />11A SANDAB COMMUNICATIONS LIMITED <br />PARTNERSHIP II - COUNTY CONSENT TO <br />ASSIGNMENT OF LICENSE TO PINNACLE TOWERS, <br />INC. UTILIZING A CONSENT AND ESTOPPEL <br />AGREEMENT <br />The Board reviewed a Memorandum of April 23, 1998: <br />TO: Honorable Board of County Commissioners <br />THROUGH: Jim Chandler, County Administrator <br />FROM: Doug Wright, Director td� <br />Emergency Services <br />DATE: April 23, 1998 <br />SUBJECT: Consent to Assignment Of License From San& Communications Limited <br />Partnership H, To Pinnacle Towers, Inc., Utilizing A Consent And Estoppel <br />Agreement <br />On March 17, 1992, the Board of County Commissioners entered into a License Agreement with <br />Sandab Communications Limited Partnership, U. The License Agreement relates to land owned <br />by the County near the solid waste transfer station at Old Dixie Highway and First Street where <br />two communications towers were constructed and used primarily by WGYL. Sandab <br />Communications is proposing to enter into an Asset Purchase Agreement with Pinnacle Towers <br />wherein Pinnacle would purchase Sandab's interest and assets in the towers. <br />Section 4 of the License Agreement provides that the Licensee may not assign the License <br />without the prior written approval of the Board of County Commissioners of Indian River <br />County and that the County will not unreasonably withhold such approval. <br />There was one amendment to the License Agreement on June 22, 1993. The purpose of the <br />amendment was to extend the term of the Agreement. The County does not lose or waive any <br />of its rights and authority as stated in the original License Agreement, including retaining two <br />free spaces on the tower and space inside the equipment building for the location of <br />communications equipment for use in the event the space is needed by the County. <br />Staff and the County Attorney have reviewed the documents and submits to the Board there is <br />no reason to withhold approval of the Assignment of License. <br />MAY 59 1998 <br />
