Keating, AIC <br />Community Developme t D' or <br />FROM: — Stan Boling, AICP <br />Planning Director <br />DATE: May 26, 1998 <br />SUBJECT: PROPOSED DEVELOPMENT ORDER (D.0) AND DRI APPROVAL FOR THE <br />HORIZON OUTLET CENTER <br />It is requested that the data herein presented be given formal consideration by the Board of County <br />Commissioners at its regular meeting of June 2, 1998. <br />On March 24, 1994, the Planning and Zoning Commission granted site plan approval for the Horizon <br />Outlet Center located in the southwest quadrant of the I-95/S.R. 60 interchange. Subsequently, the <br />existing outlet center was developed, consisting of 333,089 square feet of retail building area on <br />44.11 acres. That amount of development was determined by the State not to constitute a <br />development of regional impact (DRI). Therefore, no DRI review was required for the existing <br />development. <br />In December 1996, the developer filed an application for development approval (ADA) with the <br />Treasure Coast Regional Planning Council for an expansion of the outlet center to double the <br />existing development intensity and expand the total project acreage to 182.82 acres. The proposed <br />expansion exceeds the DRI threshold, and requires DRI review and approval of the total project <br />(existing plus proposed development). In January 1997, the developer entered into a predevelopment <br />agreement (PDA) with the state and county, allowing preliminary development of 39.53 acres for <br />golf course and related improvements (driving range, chipping practice area, temporary clubhouse, <br />Permanent maintenance facility, parking areas, and roadways) prior to approval of the DRI <br />application. At that time, the county granted the developer special exception use and conceptual site <br />plan approval for a 9 -hole golf course that includes the PDA area plus additional acreage, all of <br />which is within the area encompassed by the DRI application. To date, the PDA site has been <br />cleared but the approved site plan has not been released for actual construction. If and when DRI <br />approval is granted, such approval and any associated D.O. conditions will supercede the PDA. <br />On February 20, 1998, the Treasure Coast Regional Planning Council, pursuant to its required DRI <br />review fimction, considered the proposed DRI project application. The Regional Planning Council <br />recommended that the county approve with conditions the DRI request and corresponding <br />development order (D.O.). State DRI rules require that the Board of County Commissioners <br />consider the request and D.O. at a public hearing. Such a public hearing before the Board was <br />originally scheduled for May 26, 1998, but was re -advertised and postponed to the June 2, 1998 <br />meeting at the applicant's request. Under county LDR requirements, the Planning and Zoning <br />Commission reviewed the request and voted 7-0 to recommend that the Board of County <br />Commissioners approve the development order with conditions (see attachment #8). <br />ANALYSIS• <br />The existing and proposed development is depicted on a master development conceptual plan that <br />is part of the DRI application.
