BOOK 106 ME 56 <br />Director Boling advised that the correct vote of the Planning and Zoning Commission <br />was 6-0 and not 7-0 as stated in the memorandum. <br />The Chairman opened the public hearing and asked if anyone wished to be heard in <br />this matter. <br />Melanie Clark, of Kimley Horn, the engineers on the project, thanked staff for their <br />help on the project. <br />It was determined that no one else wished to be heard and the Chairman closed the <br />public hearing. <br />ON MOTION by Commissioner Eggert, SECONDED BY <br />Commissioner Adams, the Board unanimously adopted <br />Ordinance 98-14 amending the Zoning Ordinance and the <br />accompanying Zoning Map from CG to PD Commercial for <br />approximately 4.76 acres of land generally located on the south <br />side of SR60 in the 8400 block and the conceptual PD plan with <br />the following conditions: 1) Prior to site plan release, the <br />applicant shall obtain all jurisdictional permits for filling the <br />isolated wetlands on site; and 2) prior to the issuance of a C.O., <br />all material proposed for the Type `B" buffer shall be installed <br />in accordance with the approved landscape plan. <br />ORDINANCE NO. 98-1A— <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE <br />ZONING ORDINANCE AND THE ACCOMPANYING ZONING MAP FROM CG <br />TO PD COMMERCIAL FOR APPROXIMATELY 4.76 ACRES OF LAND <br />GENERALLY LOCATED ON THE SOUTH SIDE OF SR 60 IN THE 8400 <br />BLOCK; AND DESCRIBED HEREIN, AND PROVIDING FOR AN EFFECTIVE <br />DATE. <br />WHEREAS, the Planning and Zoning Commission, sitting as the local planning agency on <br />such matters, has held a public hearing and subsequently made a recommendation regarding this <br />rezoning request; and <br />WHEREAS, the Board of County Commissioners of Indian River County, Florida, did <br />publish and send its Notice of Intent to rezone the hereinafter described property; and <br />June 9, 1998 <br />48 <br />-I <br />
