O'Brien, Assistant County AttorneyjY0 <br />DATE: June 3, 1998 <br />SUBJECT: Public Hearing -June 9, 1998 <br />An Ordinance Amending Section 307.02 Prohibition Parking in <br />Handicap Aisles <br />The Florida Legislature has recently amended the statutes governing handicap parking. <br />Section 316.1955(5)(c), F.S., prohibits parking in an access aisle. Section316.1955(7), <br />F.S., prohibits parking a vehicle in a disabled parking space unless the vehicle displays a <br />disabled parking permit and the vehicle is actually transporting the person to whom <br />the permit was issued. <br />The proposed a ordinance incorporates these changes so as to allow local enforcement. <br />A public hearing date of June 9, 1998 was set by the Board of County Commissioners. <br />The Chairman opened the public hearing and asked if anyone wished to be heard in <br />this matter. There being none, he closed the public hearing. <br />ON MOTION by Commissioner Eggert, SECONDED BY <br />Commissioner Adams, the Board unanimously adopted <br />Ordinance 98-15 amending Section 307.02 of the Indian River <br />County Code to prohibit parking in handicap aisles. <br />ORDINANCE 98-15 <br />AN ORDINANCE OF THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, <br />FLORIDA, AMENDING SECTION 307.02, INDIAN <br />RIVER COUNTY CODE TO PROHIBIT PARKING IN <br />HANDICAP AISLES. <br />WHEREAS, the Indian River County Code under Section 307.02 regulates <br />parking for certain handicapped persons; and <br />- WHEREAS, the Florida legislature has amended the statute governing <br />handicapped parking, and <br />June 9, 1998 <br />0 0 <br />
