• <br />WHEREAS, to enforce these regulations on the local level code amendments <br />NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF <br />COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, that: <br />SECTION 1. AMENDMENT. <br />Current Section 307.02 is hereby designated paragraph (a) of Section 307.02 and <br />a new paragraph (b) is added to Section 307.02 to read as follows: <br />(b) No person shall park any vehicle at any time in an access aisle to a <br />handicap designated parking area. Further, no person shall park a vehicle <br />in a disabled parking space unless the vehicle displays a disabled parking <br />permit and the vehicle is actually transporting the person to whom the <br />permit was issued. <br />SECTION 2. REPEAL. <br />Those portions of the Indian River County Code superseded or in conflict <br />with the provisions herein adopted, in particular Chapter 401, are hereby repealed. <br />SECTION 3. SEVERABILITY. <br />If any section, or any sentence, paragraph, phrase, or word of this ordinance <br />is for any reason held to be unconstitutional, inoperative, or void, such holding <br />shall not affect the remaining portions of this ordinance, and it shall be construed to <br />have been the legislative intent to pass the ordinance without such unconstitutional, <br />invalid or inoperative part. <br />SECTION 4. EFFECTIVE DATE. <br />A certified copy of this ordinance, as enacted, shall be filed by the Clerk <br />with the Office of the Secretary of State of the State of Florida within ten days after <br />enactment, and this ordinance shall take effect upon filing with the Secretary of <br />State. <br />Approved and adopted by the Board of County Commissioners of Indian <br />River County, Florida, on this 9th day of June , 1998. <br />This ordinance was advertised in the Vero Beach Press -Journal on the <br />2 9 t hiay of M ay , 1998, for a public hearing to be held on the 9 g h day of <br />June , 1998, at which time it was moved for adoption by Commissioner <br />Eggert , seconded by Commissioner Adams , and <br />adopted by the following vote: <br />June 9, 1998 <br />RE <br />BOOK 101 FACE 77 <br />J <br />
