ON MOTION by Commissioner Eggert, SECONDED BY <br />Commissioner Ginn, the Board unanimously approved that staff <br />test, by summary judgment, the issue of "loss of access." If the <br />County prevails, staff is authorized to defend the lawsuit. If the <br />County loses the summary judgment, then staff will return to the <br />Board of County Commissioners with a recommendation as to <br />how to proceed including possible settlement. <br />Commissioner Adams asked if procedures were in place to avoid this problem in the <br />future, and Public Works Director James Davis explained in detail how this was an unusual <br />situation which went back to 1990 when the County first began negotiating with the property <br />owners, the Helseth family, to acquire land for the Oslo Road intersection improvements. <br />A subsequent sale of the property to Blake & Torres coupled with lack of communication <br />resulted in this problem <br />13.A.1.
