They are attempting to preserve the development rights allowable under the Code and <br />had not foreseen the opposition now being encountered. <br />Commissioner Ginn felt nothing should be built seaward of the 1987 CCCL <br />considering the erosion in that area. <br />In response to questioning from Commissioner Ginn, Director Keating explained that <br />the County prohibits construction seaward of the 1981 CCCL but the area between the 1981 <br />and the 1987 CCCL is regulated by the State. <br />Mr. McGuire noted that in order to build in front of the CCCL, you have to construct <br />on pilings under a set elevation. Any building has to be designed for water to go through and <br />there are increased wind load requirements. The State is trying to prevent seawall <br />applications and, under the submitted plan, Windsor would never be allowed to build a <br />seawall. <br />Commissioner Adams felt the general philosophy is not to encourage further <br />development on the beach in an effort to limit the density and potential damages from storm <br />events while, at the same time, balancing the rights of people who own property to use it. <br />Those people who have chosen to live in these houses are taking a risk and recognize it. <br />Bob Burnett, Vice President of Construction at Windsor, stated that Windsor is here <br />today on a planning issue to incorporate this piece of property into the PD. They believe <br />they are being good neighbors. <br />Jan Smith, 2250 Sanderling Lane, commented that the whole island, except for <br />Orchid, is developed as single-family residences and park areas. She believed the services <br />to the area are being stretched to the limit; that it would be very difficult to evacuate multi- <br />family development; that this development would damage the fragile environment in the <br />area; and asked the Board to wait to see exactly what is being proposed. <br />The Vice Chairman asked if anyone else wished to be heard regarding this matter. <br />There being none, the Vice Chairman closed the public hearing. <br />Commissioner Ginn noted that she intended to vote for the Planning & Zoning <br />recommendation of 24 residential units with a prohibition on any structure seaward of the <br />1987 CCCL. <br />OCTOBER 6, 1998 <br />-49- <br />
