Murphy Deed Reservation Setback Compliance - Update on <br />Staff Review Procedure <br />The Board reviewed a Memorandum of October 14, 1998: <br />TO: James Chandler <br />County Administrator <br />THROUGH: Robert M. Keating, AICP Alue— <br />Community Development Director <br />_6. <br />FROM: Stan Boling, AICP <br />Planner Director <br />DATE: October 14, 1998 <br />SUBJECT: Update on Staff Review Procedures For Murphy Deed Reservation Setback <br />Compliance <br />It is requested that the Board of County Commissions consider the data herein at the regularly <br />scheduled meeting of October 20, 1998. <br />BACKGROUND <br />Last month, the Board heard an appeal from Stuart and Deborah Segal involving a detached garage <br />proposed to be built within a Murphy Deed Reservation setback. As reported and discussed at that <br />hearing, the Segal's building permit sketch did not show any Murphy Deed Reservation on their <br />property. Furthermore, because their permit application was for a minor accessory building, staff <br />did not conduct a Murphy Deed Reservation review at the time of building permit review. Instead <br />staff relied solely on the applicant's sketch. At the conclusion of the hearing, the Board directed <br />staff to report back regarding revised staff procedures to ensure that all proposed buildings and <br />additions are reviewed for compliance with Murphy Deed Reservation setbacks. Planning staff has <br />coordinated with staff from Building and Public Works, and has revised internal procedures for <br />reviewing proposed buildings and additions. <br />ANALYSIS <br />Based upon these revised procedures, building permit applications for accessory structures like the <br />Segal's garage, as well as building additions, will be reviewed for compliance with setbacks from <br />Murphy Deed Reservation areas. Such reviews performed by staff will determine whether or not <br />a Murphy Deed Reservation was ever filed over an applicant's development site.
