Additions and accessory buildings not in flood zones, Planner -of -the -day will <br />on sites that front road segments having potential determine relevant proposals <br />Murphy Reservation areas and Public Works will perform <br />the Murphy Reservation reviews. <br />*Note: Item #4 is the only change to review procedures. For project types identified in items <br />1, 2, and -3, Murphy Deed Reservation reviews have been in effect for years. <br />The review procedures described above will ensure that permits will not be issued for new buildings <br />and additions unless said proposed structures meet applicable zoning setbacks from Murphy <br />Reservation areas. When Public Works staff confirms that a proposed building or addition would <br />encroach into a potential Murphy Reservation setback area, the applicant will be notified. The <br />applicant will then need to either document release of the Murphy Reservation, or re -locate the <br />proposed structure, so as to comply with setback requirements. As discussed during the Segal <br />hearing, although this new process will require more time and effort from some building permit <br />applicants, the "Segal situation" will be avoided. <br />In addition to the referenced procedural changes, Public Works and Property Appraiser's staff are <br />working toward better mapping of Murphy Deed Reservation and reservation release information. <br />Currently, staff has maps showing areas where Murphy Deed Reservations were in effect at one time <br />in the past. However, there are currently no maps showing areas where the Murphy Deed <br />Reservations are still in effect and to what extent. <br />Recently, Public Works staff obtained information on Murphy Reservation releases from the State. <br />This newly acquired information can be compared to previously catalogued reservation deed <br />information to more accurately determine the extent of existing reservations that are still in effect. <br />Those areas can be mapped as road right-of-way. Murphy Deed and release information has been <br />given to Property Appraiser's staff, who are mapping the information in a "pilot project" area. It is <br />staff s hope that the pilot project proves useful to the Property Appraiser's Office and that eventually <br />Property Appraiser's maps for the entire county will show the areas where Murphy reservation rights <br />are still held by the public. <br />Uwlai ►II MMI <br />This report is for information only.
