9 <br />'i <br />BOOK _ 7 PAGE 404 <br />The proposed stormwater management system consists of a series of lakes, linked by pipes, <br />which ultimately outfall to an Indian River Farts Water Control District canal. The <br />stormwater management system will be "oversized" to provide some stormwater capacity for <br />the new 58* Avenue road widening improvements. <br />9. Utilities: The project will be served by county water and wastewater services. These utility <br />provisions have been approved by the Department of Utility Services and the Environmental <br />Health Department. Although the site is outside the Urban Service Area, connection to water <br />and wastewater services are allowed because the proposed development is within 500' of the <br />Urban Service Area (as provided for in the comprehensive plan water and sewer sub - <br />elements), and because Utility Services has determined that capacity is available. <br />10. Landscape Plan: The landscape plan is consistent with Chapter 926 and section 971.14(4) <br />of the county's LDRs. Chapter 926 constitutes the county's general landscape regulations, <br />while section 971.14(4) constitutes the specific land use criteria for educational facilities. <br />These criteria include a requirement for a Type "C" buffer on the south and west property <br />lines. <br />11. Caribbean Fruit Fly Host Plant: The applicant has agreed not to plant Caribbean fruit fly <br />host plants and to allow removal of any wild growing Caribbean fiuit fly host plants. This <br />will be a condition of site plan approval. <br />12. Concurrency: The developer has executed a concurrency acknowledgment agreement which <br />satisfies the project's concurrency requirement with regard to site plan approval. <br />13. Environmental Issues: The environmental planning section has verified that there are no <br />wetlands or native upland habitat on site. Therefore, no county upland set-aside or wetland <br />mitigation requirements apply. The plan, however, does provide for creation of a littoral <br />zone in the largest lake; this satisfies county littoral zone requirements. <br />14. Dedications & Improvements: The required dedications and improvements are being <br />addressed in a separate developers agreement with public works. The following <br />improvements are required. <br />Pursuant to the county's comprehensive bikeway and sidewalk plan, a 5' wide <br />sidewalk is required along 581h Avenue. This will need to be completed or bonded <br />prior to the issuance of a C.O. <br />The applicant is required to pave 1r Street from 58'" Avenue to its project entrance. <br />The paving will need to be completed prior to the issuance of a certificate of <br />occupancy. The county will ultimately construct this portion of 12'" Street, but if the <br />county has not paved it by the time the applicant is ready for a C.O. the applicant will <br />need to provide temporary paving. The applicant will need to pave 12' Street to the <br />westernmost driveway when it is constructed. <br />A westbound left tum lane is required on 12'h Street at the project's entrance. The <br />left turn lane will need to be constructed prior to the issuance of a certificate of <br />occupancy, for Phase 11. <br />The county is negotiating to acquire an additional 20' of right-of-way for 58m Avenue. <br />While the site plan accommodates this acquisition, the negotiated purchase will take <br />place outside of the site plan approval process. No additional right-of-way is <br />required from the site for 12'" Street since the site is on the south side of a water <br />control district canal. <br />Thus, all of the required improvements will be provided or bonded with the appropriate <br />phase. <br />15. School Special Exception Use Specific Land Use Criteria for Educational Facilities: <br />1. Sites for secondary schools shall be located near thoroughfares so as to discourage <br />traffic along local residential streets in residential subdivisions. Elementary schools <br />should be discouraged from locating adjacent to major arterial roadways; <br />Note: The site proposes both a primary and secondary school. Based on the <br />facility design and setbacks, the school is located at an appropriate location <br />relative to the county's thoroughfare plan road system. No access through <br />residential areas is proposed, and the elementary school facilities will not be <br />located close to thoroughfare plan roads. <br />OCTOBER 27, 1998 <br />
