BOOK 107 PAGE �.. <br />Planning Director Stan Boling noted that this project is a botanical garden and <br />associated facilities which abut Vista Gardens to the east. The request is for an approval to <br />re-establish the gardens. All commercial development will be on the west side of the site <br />including the parking lot, a cafe, and a small office. Existing trees will be preserved with <br />additional trees to be planted. There are many phases to the project. <br />Janet Alford, 1645 9 - Street SW, stated that the first phase will take approximately <br />2 to 4 years. <br />The Chairman opened the public hearing and asked if anyone wished to be heard <br />regarding this matter. There being none, the Chairman closed the public hearing. <br />The Chairman commented that the plans were very impressive. <br />ON MOTION by Commissioner Adams, <br />SECONDED by Commissioner Ginn, the Board <br />unanimously granted the special exception use <br />approval with the following conditions: (1) prior to <br />site plan release, the developer shall execute <br />reciprocal access agreements with the Indian River <br />Farms Water Control District and the County <br />Department of Utility Services to ensure access to <br />the south relief canal and utilities improvements; (2) <br />prior to the issuance of a Certificate of Occupancy <br />the applicant shall either build or bond out the <br />required sidewalk improvement along the site's <br />U.S.#1 frontage; and (3) prior to the issuance of a <br />Certificate of Occupancy for Phase I, a Type "D" <br />buffer must be constructed along the project's east <br />property line; all as recommended by staff. <br />NOVEMBER 17, 1998 <br />-46- <br />• 0 <br />
