Keating, CP 'Lie/f/ <br />Community Development <br />THROUGH: Stan Boling, AIICP <br />Planning Director <br />FROM: Eric Blad13 <br />Staff Planner, Current Development <br />DATE: November 20,1998 <br />SUBJECT: DLF International Inc.'s Request for Special Exception Use Approval for an <br />Agricultural Business and Appeal of Planning and Zoning Commission's Denial of <br />an Administrative Permit/Site Plan for a Packing House <br />It is requested that the data herein presented be given formal consideration by the Board of County <br />Commissioners at its regular meeting of December 1, 1999. <br />Mosby and Associates, Inc., on behalf of DLF International, Inc., has submitted an application for <br />special exception use approval for an agricultural business to broker and promote local citrus <br />domestically and abroad In conjunction with the special exception use, the applicant submitted a <br />request for administrative per =site plan approval for a packing house. The subject 4 acre site is <br />currently under contract for sale to DLF International, Inc. and is located at the northwest comer of <br />I- Street S.W. and 58"' Avenue. The subject property is zoned A-1, Agricultural (up to 1 unit per <br />5 acres), and is looted immediately west of the Urban Service Area. <br />An agricultural business is defined as a commercial operation that is related to processing or <br />servicing bona fide agricultural production (Le. citrus, farming, ranching, etc.). Agricultural <br />businesses are allowed in A 1 zoning by special exception use approval, subject to the special land <br />use provisions of section 971.08, of the county's land development regulations and subject to site <br />plan approval requirement. The proposed packinghouse is also subject to special land use criteria <br />as well as site plan requirements. <br />At its October 22,1998 meeting, the Planning and Zoning Commission voted (4-1) to recommend <br />that the Board of County Commissioners deny special exception use approval for the Agricultural <br />business and denied the administrative permit/site plan application for the packinghouse. The <br />Commission's action is based on findings that: <br />1. The proposed citrus brokerage is principally an office use that is more appropriately <br />located in a commercial or office zoning district <br />2. The proposed conversion of a nonconforming barn structure to a packing house <br />would result in an intensification of use without reducing the degree of <br />nonconformity. Such a change is contrary to the county's nonconformities <br />regulations. <br />3. The proposed use of the site's easternmost driveway along 1' Street S.W. does not <br />satisfy LDR standards (applied to site plan projects) for driveway separation distance <br />from an intersection. <br />As provided for in the LDRs, the applicant has appealed the Planning and Zoning Commission's <br />action to deny the administradve permit/site plan application. The Board of County Commissioners <br />is now to consider the appeal and either uphold the Planning and Zoning Commission's decision or <br />overturn that decision in part or in whole. The Board of County Commissioners is to also act on the <br />special exception use request for an agricultural business and approve, approve with conditions, or <br />DECEMBER 1, 1998 <br />I <br />
