*PD Process / PZC and BCC Reviews <br />The PD project review and approval process is as follows: <br />Approval Needed Reviewing Body <br />I- Conceptual Plan/Special Exception PZC & BCC <br />2. Preliminary PD Plan PZC <br />3. Land Development Permit or Waiver Staff <br />4. Final PD Plat BCC <br />The applicant has requested approval of the first two steps. <br />Planning and Zoning Commission Review <br />At its regular meeting of August 27,1998, the Planning and Zoning Commission voted unanimously <br />(6-0) to recommend that the Board of County Commissioners approve the special exception use. <br />The Planning and Zoning Commission approved the preliminary PD plan subject to the Board of <br />County Commissioners approval of the special exception use. As a result of comments at the public <br />hearing, the Planning and Zoning Commission recommended that a condition be added to the <br />special exception approval regarding a pedestrian easement through the project to link all parts of <br />Pelican Pointe (see attachment #4). Staff has added the condition to this report. <br />Board of County Commission Review/Action <br />If the PD special exception use request is approved by the Board of County Commissioners, the <br />preliminary PD approval will become effective. The applicant will then need to obtain a land <br />development permit or waiver for the required PD infrastructure improvements. <br />The developer submitted a similar PD approval request in 1996 to construct 19 single family <br />detached residential homes on the 3.6 acre subject property. However, that proposal would have <br />required the developer to obtain approval from the existing Pelican Pointe unit owners to allow use <br />of their common property to meet PD setback/buffering requirements. That application was tabled <br />by the Board of County Commissioners on October 15, 1996, and subsequently expired. The current <br />proposal scales back the number of proposed units and satisfies all PD requirements within the 3.6 <br />acres. <br />The Board of County Commissioners is to approve, approve with conditions, or deny the special <br />exception use request. Pursuant to Section 971.05 of the LDRs, the Board is to consider the <br />appropriateness of the requested use for the subject site and surrounding area. The county may <br />attach any conditions and safeguards necessary to mitigate impacts and to ensure compatibility of <br />the use with the surrounding area. <br />ANALYSIS: <br />1.
