• <br />• <br />County Attorney Vitunac announced that this matter is quasi judicial and everyone <br />wishing to offer testimony should be sworn. He administered the oath and requested that <br />speakers note for the record that they have been sworn. <br />Commissioner Ginn revealed that she had a conversation with someone yesterday on <br />this matter. She stated that she would be happy to answer any questions regarding that <br />conversation. <br />Planning Director Stan Boling reviewed the project and noted that the basis of the <br />appeal is the indoor gun range which was not a specifically listed use. This is strictly an <br />interpretation issue. There are 314 categories listed and staff had to make an interpretation <br />as to the "use" category. <br />Commissioner Stanbridge questioned the dimensions of the gun range portion of the <br />building, and Director Boling responded that that particular portion is 50 feet X 90 feet. <br />Chairman Macht noted that this item is not designated as a public hearing but, due to <br />the nature of the appeal, public comment will be allowed. He asked the speakers to be as <br />brief as possible. <br />Victor Hart, Sr., 4635 34' Avenue, had been sworn. He believed that planning on <br />this matter should have been stopped from day number 1 because the request was for a usage <br />that did not exist in the County Plan. He felt that there are no similar uses in the County and <br />that allowing this use could set a precedent for the whole state. He believed it was no <br />accident this request was made in this area which is considered to be "one of the weak areas" <br />of the County. <br />Attorney Bruce Barkett, 756 Beachland Boulevard, advised that he is representing <br />the developer and will be glad to answer any questions. <br />Connie Gates, 9070 US91, Sebastian, stated that she is a member of the Board of <br />Directors of the Civic Association of Indian River County, and is speaking on their behalf. <br />She also believed that an indoor shooting gallery is not a defined use. She was concerned <br />that allowing a liberal interpretation of the use definitions exposes the County to many <br />unwanted land use possibilities which could ccmpromise the health. s=-fetty -and %�,elfare of <br />the County.
