Attorney Barkett for the applicant cited Section 911.04(2)(b) of the Code which states: "Community Development Director shall determine ...". He understood the concerns of the residents but believed the Board is not the correct administrative body to hear this appeal. He felt that the citizens are asking the Board to act as a legislature.
