Thompson, P.E. <br />Capital Projects Manager <br />SUBJECT: Phase II Kings Highway Improvement Developer's Agreement between <br />Indian River County and First Church of God, Inc. <br />DATE: March 3, 1999 <br />DESCRIPTION AND CONDITIONS <br />An additional twenty feet (20') of right-of-way is needed along the most side of Kings <br />Highway adjacent to the First Church of God development. The attached developer's <br />agreement provides for the purchase of needed right-of-way and the construction of <br />drainage facilities on the church site. <br />The ponds on the church site have been designed to accept the runoff from King's <br />Highway (one acre equivalent pond area) and runoff from the church site (four acre <br />equivalent pond area). Based on these equivalent areas, the County will pay 20% of the <br />monthly pond maintenance cost. <br />The cost of the right-of-way and County's portion of the drainage improvements is <br />$100,450 as outlined in the agreement. <br />RECOMMENDATIONS AND FUNDING <br />Staff recommends that the Board of County Commissioners approve the attached <br />Developer's Agreement. <br />ATTACHMENT <br />Developer's Agreement <br />Vice Chairman Adams questioned Public Works Director James Davis on the cost and <br />future costs to the County under this agreement. <br />Public Works Director James Davis explained in detail the costs as set forth in the <br />agreement and explained the economics. He mentioned that the value of the land was similar <br />to that in past agreements of this nature. He also spoke of the environmental and aesthetic <br />values of having a large retention pond versus smaller ones and advised of the County's <br />responsibilities in maintaining the pond. In response to Vice Chairman Adams' question <br />about timing, Director Davis advised that this is part of Phase 2 of the Kings Highway <br />MARCH 9,1999 <br />75 <br />BOOK 103 Fa1GE 5 iia <br />
