ON MOTION by Commissioner Adams, SECONDED BY <br />Commissioner Tippin, the Board unanimously adopted <br />Ordinance 99-010 establishing regulations governing alarms <br />responded to by law enforcement agencies in Indian River <br />County. <br />12 /29/ 98(ord \alarm)ow <br />ORDINANCE 99 - i0 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, <br />FLORIDA, ESTABLISHING REGULATIONS <br />GOVERNING ALARMS RESPONDED TO BY LAW <br />ENFORCEMENT AGENCIES IN INDIAN RIVER <br />COUNTY. <br />WHEREAS, up to 99 percent of alarm signals are false alarm signals; and <br />WHEREAS, responding to these false alarms is a waste of manpower; and <br />WHEREAS, other Florida counties with similar experiences have adopted <br />ordinances similar to this ordinance with the result that there has been a dramatic <br />decrease in the number of false alarms; and <br />WHEREAS, the Board of County Commissioners determines that it is in the <br />public interest to regulate alarms, <br />NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF <br />COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, that: <br />SECTION 1. AMENDMENT. <br />Current Chapter 301, False Alarms, of the Indian River County Code is <br />hereby amended by entitling present Sections 301.01 through 301.08 "Part I - False Fire <br />Alarms" and by adopting Exhibit A as "Part II - False Alarms - Law Enforcement." <br />SECTION 2. SEVERABILITY. <br />If any section, or any sentence, paragraph, phrase, or word of this ordinance is <br />for any reason held to be unconstitutional, inoperative, or void, such holding shall not <br />affect the remaining portions of this ordinance, and it shall be construed to have been <br />the legislative intent to pass the ordinance without such unconstitutional, invalid or <br />inoperative part. <br />SECTION 3. EFFECTIVE DATE. <br />This ordinance shall take effect Jun e 1 ,1999. <br />A certified copy of this ordinance, as enacted, shall be filed by the Clerk with <br />the Office of the Secretary of State of the state of Florida within ten days after <br />enactment, and this ordinance shall take effect upon filing with the Secretary of State. <br />Approved and adopted by the Board of County Commissioners of Indian River <br />County, Florida, on this ?,qday of March ,1999. <br />This ordinance was advertised in the Vero Beach Press Journal on the IL. day <br />of March , 1999, for a public hearing to be held on the 23 day of <br />MARCH 23, 1999 <br />25 <br />• <br />BOOK 103 FACE 759 <br />
