<br />When initiated, this application involved both a land use amendment and a rezoning request. As
<br />with most such applications, both requests were processed concurrently. State law, however,
<br />provides some special requirements for county initiated rezoning requests, such as the subject
<br />request, that involve more than 10 acres. Among those special requirements are the following:
<br />• The Board must hold 2 advertised public hearings; and
<br />• The second hearing must be held at least 10 days after the first hearing and must be
<br />advertised at least 5 days prior to the hearing.
<br />The first rezoning public hearing was held at the March 16, 1999 Board of County Commissioners
<br />meeting. At that meeting, the Board voted 5 to 0 to hold the second rezoning public hearing at the
<br />April 6, 1999 Board of County Commissioners meeting. Because that meeting meets the
<br />requirements for the second hearing, the rezoning ordinance can be adopted following that public
<br />hearing.
<br />On October 8,1998, the Planning and Zoning Commission voted 7 to 0 to recommend that the Board
<br />of County Commissioners approve this request.
<br />- Subject Property 1
<br />Located at the northeast comer of 8`h Street and Indian River Boulevard, Subject Property 1 consists
<br />of ±21 acres of coastal oak hammock and *16 acres of estuarine wetlands. The coastal oak
<br />hammock generally is located near Indian River Boulevard, while the estuarine wetlands generally
<br />are located along the Indian River Lagoon. Adjacent properties to the north also contain coastal oak
<br />hammock along Indian River Boulevard and estuarine wetlands along the Indian River Lagoon.
<br />While all of Subject Property 1 is zoned RS -1, Single -Family Residential District (up to 1 unit/acre),
<br />only the eastern portions of adjacent properties to the north and south are zoned RS -1. The western
<br />portions of those properties are zoned RM -10, Multiple -Family Residential District (up to 10
<br />units/acre).
<br />Land abutting Subject Property 1 on the south contains the recently completed River Park Place
<br />Multiple -Family development. West of Subject Property 1, across Indian River Boulevard, land is
<br />zoned RM -10 and contains the Kyles Run Apartments.
<br />Although zoned RS -1 in the County Zoning Atlas, environmentally important wetlands, such as
<br />those along the Indian River Lagoon, are deemed to be zoned Con -2, wetland Conservation District
<br />(up to 1 unitt40 acres).
<br />- Subject Property 2
<br />Located on the western edge of the south portion of the barrier island, just west of St. Christopher's
<br />Harbor Subdivision, Subject Property 2 is nearly surrounded by the Indian River Lagoon. Zoned
<br />RS -1 in the county zoning atlas, Subject Property 2 is undeveloped and consists entirely of
<br />impounded estuarine wetlands. Nearby lands on the barrier island, to the east of Subject Property
<br />2, are zoned RS -3, Single -Family Residential District (up to 3 units/acre), and consist of single-
<br />family subdivisions and unplatted lots.
