The Chairman opened the public hearing and asked if anyone wished to be heard in <br />this matter. There being none, the Chairman closed the public hearing. <br />ON MOTION by Commissioner Adams, <br />SECONDED by Commissioner Ginn, the Board <br />unanimously granted the conceptual plan and special <br />exception use approval for the place of worship, <br />with the following conditions: (1) Prior to release of <br />any approved major (final) site plan; the developer <br />shall: (a) grant a 5' wide drainage and utility <br />easement without compensation along the project's <br />87`ti Street frontage; and (b) obtain a right-of-way <br />abandonment for the excess 87'h Street right-of-way <br />on the west half of the site; and (c) dedicate without <br />compensation 35' of right-of-way for 46' Avenue <br />from CR -5 10 to the project's proposed 46'h Avenue <br />entrance; and (2) prior to the issuance of a <br />Certificate of Occupancy, the developer shall pave <br />_. 46' Avenue from CR -5.10 to the project's 46" <br />Avenue entrance; all as recommended by staff. <br />9.C.
