TRI PARTNERS - DEVELOPER'S AGREEMENT FOR <br />CONSTRUCTION OF CONVENIENCE STORE AT 20TH <br />AVENUE SW AND OSLO ROAD <br />The Board reviewed a Memorandum of June 24, 1999: <br />TO: James E. Chandler, <br />County Administrator <br />FROM: James W. Davis, P.E., <br />Public Works Director <br />SUBJECT: Developer's Agreement with TRI Partners - <br />Construction of Convenience Store at 20 Avenue SW <br />DATE: June 24, 1999 <br />DESCRIPTION AND CONDITIONS <br />Tri Partners, L.L.C., plans to construct a convenience store at 20°° <br />Avenue SW and Oslo Road. Planned improvements are as follows: <br />Phase 1 a) a two lane paved road on 19th Avenue SW between <br />Oslo Road and the project south property line, <br />b) culverting the Sublateral Canal E-8 parallel <br />to Oslo Road; <br />Phase 2 a) turn lane at 20U' Avenue SW to serve 101-h <br />Street, SW; <br />b) paving 19th Avenue SW from the project south <br />property line to 10th Street SW; <br />c) paving of 10"r' ✓Street SW east of 20a' Avenue SW <br />The County has prepared a Developer's Agreement with Tri Partners, <br />who are funding 75% of the cost of the engineering, permitting and <br />construction. The County will reimburse the developer 251% of the <br />cost upon completion of Phase I in the estimated amount of <br />$16,859.95 and $21,197.46 upon completion of Phase II. <br />ALTERNATIVES AND ANALYSIS <br />Staff presents the following alternatives: <br />Alternative No. 1 <br />Approval of the attached developer's agreement with the <br />County funding 25% of the cost or $38,057.41. <br />Alternative No. 2 <br />Deny approval. <br />RECOMMENDATIONS AND FUNDXNG <br />Staff recommends approval of the agreement. Funding to be from <br />Traffic Impact Fee funds, District 6, as budgeted for the Oslo Road <br />project ($8,613.65), and 20th Avenue SW turn lane ($6,301.26) and <br />($23,142.50) from Local Option Sales Tax revenue budgeted for <br />Special Assessment Paving. <br />JULY 69 1999 <br />• <br />-77- <br />BOOK PAGE /; <br />
