BOOK 1W PAGE Z5 <br />Because the subject property is located within an area designated as M-1 on the county's future land <br />use plan map and is located within the county's urban service area, and the proposed zoning district <br />would permit residential uses no denser than six units/acre, the proposed request is consistent with <br />Future Land Use Element Policies 1.13 and 1.14. _ <br />While Future Land Use Element Policies 1.3, 1.13, and 1.14 are particularly applicable to this <br />request, other comprehensive plan policies and objectives also have relevance. For that reason, staff <br />evaluated the subject request for consistency with all plan policies and objectives. Based upon that <br />analysis, staff determined that the request is consistent with the comprehensive plan. <br />Environmental protection regulations are the same for both the CG and the RM -6 zoning districts. <br />Because the subject property is not environmentally significant nor environmentally important, <br />development of the site will not impact significant natural resources. <br />As noted in the Description and.Conditions section of this staff report, state law requires that the <br />Board of County Commissioners hold two public hearings prior to approving county initiated <br />rezonings of more than ten acres. The subject request meets those criteria. <br />The Jul; 13, 1999 Board of County Commissioners meeting will meet state requirements for one <br />of the public hearings. The second public hearing then must be held at least 10 days after the first <br />hearing. Additionally, state law requires that at least one of the public hearings be held after 5:00 <br />p.m. on a weekday, unless four commissioners vote to conduct that hearing at another time of day. <br />In this case, the future use of the subject property already has been discussed at numerous public <br />hearings and public meetings, "including meetings concerning the Evaluation and Appraisal Report <br />(EAR) and the EAR based amendments. Therefore, holding the second rezoning public hearing at <br />9:05 a.m. at a regular Board of County Commissioners meeting would be sufficient to ensure public <br />participation. <br />For that reason, staff feels that it would be appropriate to hold the second rezoning public hearing <br />at 9:05 a.m. on July 27, 1999. <br />The requested zoning is compatible with the surrounding area, and is consistent with the goals, <br />objectives, and policies of the comprehensive plan. Rezoning the site, as requested, will have no <br />negative impacts on environmental quality or the provision of public facilities and services. The <br />subject property is located in an area deemed suitable for residential development. The request <br />meets all applicable criteria. For those reasons, staff supports the request. <br />Staff recommends that the Board of County Commissioners provide direction to staff regarding this <br />county initiated rezoning and direct staff to schedule the second rezoning public hearing for 9:05 <br />a.m., at the regular commission meeting of July 27, 1999. <br />ATTACHMENTS <br />1.
