8 0 0 K i .,L F't1GF <br />7.L GOVERNMENT IN THE SUNSHINE -CULTURAL COUNCIL: COUNCIL ON <br />AGING: SUBSTANCEABUSE COUNCIL: AND CHAMBER OF COMMERCE <br />The Board reviewed a Memorandum of July 30, 1999: <br />TO: <br />Boarcl of CountyCommissioners <br />FROM: <br />a� <br />Office of the County Attorney <br />DATE: <br />July 30, 1999 <br />RE: <br />Government in the Sunshine <br />Chairman Macht, based on information he had received, made inquiry as to the <br />applicability of the Sunshine Law to the Local Arts Agency (Cultural Council of <br />Indian River County). A search of recent Attorney General Opinions shows <br />several opinions directed to this type of organization and its operation. These <br />opinions reach the conclusions that such organizations are subject to the <br />Sunshine Law. In reviewing these opinions, it is clear that several organizations <br />in the County come within the ambit of the Attorney General Opinions that place <br />their meetings under the Sunshine Law. Attorney General Opinion 98-49 (copy <br />attached) is directed to the Lake County Cultural Council and AGO 98-55 (copy <br />attached) is directed to the St. Lucie County Council on Aging. It appears that <br />these opinions applied to organizations in the County would require the following <br />organizations to conduct their meetings under the Government in the Sunshine <br />Laws of the State of Florida when any item of a governmental function is <br />discussed.. <br />1. Cultural Council of Indian River County <br />2. Council on Aging <br />3. Substance Abuse Council <br />4. The Chamber of Commerce of Indian River County <br />A review of the operations and funding of other similar organizations will be <br />conducted to determine if they should be added to the above list. <br />A draft letter (copy attached) to the above named agencies has been prepared <br />for Board concurrence. <br />AUGUST 24, 1999 <br />-36- <br />
