• <br />County Attorney Vitunac stated that his office has discussed the matter with the <br />Florida League of Cities and the County's litigation counsel. The County is always in favor <br />of settlement and would certainly encourage Mr. Bartonto take any settlement offers directly <br />to Roberts and Reynolds, the County's litigation cow§el. He also advised the Board that the <br />case will soon be going to court and the County's counsel has advised that they are confident <br />of winning. <br />Lewis Barton stated that he appeared in an attempt to get some assistance or direction <br />from the Board. He felt that he had not been making progress in talks with Mr. Reynolds and <br />reminded the Board of the cost to the County for this litigation. <br />County Attorney Vitunac again suggested that Mr. Barton should make any offers of <br />settlement directly to Roberts and Reynolds. <br />Mr. Barton felt that he could reach some agreement with the County but not with the <br />County's attorneys. He felt they are at a standoff. <br />County Administrator Chandler noted that there are also several County employees <br />who are involved in the litigation and who are also represented by counsel. <br />Deputy County Attorney Will Collins advised that Mr. Reynolds had made a trip to <br />Vero Beach to meet with Mr. Barton and his counsel and almost an entire day was spent in <br />an effort to reach a settlement. The settlement agreement was submitted to Mr. Barton's <br />attorney who then revised the agreement and the revisions were delivered to Mr. Reynolds. <br />The County then submitted another settlement offer which was also rejected.
