• <br />ORDINANCE NO. 99-2 3_ <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE ZONING <br />ORDINANCE AND THE ACCOMPANYING ZONING MAP FROM CH TO CG, FOR <br />PROPERTY LOCATED ON THE EAST SIDE OF OLD DDQE HIGHWAY, ±912 FEET SOUTH <br />OF 45TH STREET (NORTH GIFFORD ROAD), AND DESCRIBED HEREIN, AND PROVIDING <br />FOR EFFECTIVE DATE. <br />WHEREAS, the Planning and Zoning Commission, sitting as the local planning agency on <br />such matters, has held a public hearing and subsequently made a recommendation regarding this <br />rezoning request; and <br />WHEREAS, the Board of County Commissioners of Indian River County, Florida, did <br />publish its Notice of Intent to rezone the hereinafter described property; and <br />WHEREAS, the Board of County Commissioners has determined that this rezoning is in <br />conformance with the Comprehensive Plan of Indian River County; and <br />WHEREAS, the Board of County Commissioners has held a public hearing for this rezoning <br />request, at which parties in interest and citizens were heard, <br />NOW, THEREFORE, BE IT ORDAINED, by the Board ofCounty Commissioners ofIndian <br />River County, Florida, that the zoning of the following described property situated in Indian River <br />County, Florida, to -wit: <br />FROM THE SOUTHEAST CORNER OF THE NORTHEAST 1/4 OF THE NORTHWEST <br />1/4 OF SECTION 26, TOWNSHIP 32 SOUTH, RANGE 39 EAST, RUN WEST 700 FEET <br />TO THE SOUTHEAST CORNER OF CHURCH PROPERTY, THENCE RUN NORTH <br />322.55 FEET; THENCE RUN WEST TO A POINT WHICH IS 150 FEET EAST OF THE <br />EAST RIGHT-OF-WAY FOR OLD U.S. HIGHWAY #1 A DISTANCE OF 131.25 FEET <br />TO THE POINT OF BEGINNING; THENCE RUN NORTHWESTERLY AND <br />PARALLEL TO THE EAST RIGHT-OF-WAY OF OLD U.S. HIGHWAY #1 A <br />DISTANCE OF 100 FEET; THENCE RUN WEST TO THE EAST RIGHT-OF-WAY LINE <br />OF OLD U.S. HIGHWAY #1 A DISTANCE OF 150 FEET; THENCE RUN <br />SOUTHEASTERLY ALONG THE EAST RIGHT-OF-WAY LINE OF OLD U.S. <br />HIGHWAY #1 A DISTANCE OF 100 FEET; THENCE RUN EAST A DISTANCE OF 150 <br />FEET TO THE POINT OF BEGINNING; SAID LAND LYING AND BEING IN INDIAN <br />RIVER COUNTY, FLORIDA. <br />Be changed from CH, Heavy Commercial District, to CG, General Commercial District. <br />All with the meaning and intent and as set forth and described in said Land Development <br />Regulations. <br />This ordinance shall become effective upon filing with the Department of State. <br />Approved and adopted by the Board of County Commissioners of Indian River County, Florida, on <br />this Th day of September, 1999. <br />This ordinance was advertised in the Press-Joumal on the 25`s day of August, 1999 for a public <br />hearing to be held on the r day of September, 1999 at which time it was moved for adoption by <br />Commissioner S t a n b r i d g e , seconded by Commissioner Adams <br />and adopted by the following vote: <br />Chairman Kenneth R.
