13. Specific Land Use Criteria for Places of Worship: The project is subject to the places of <br />worship specific land use criteria of Chapter 971.28(5)(d). These criteria are as follows: <br />a. No building or structure shall be located closer than thirty (30) feet to any property <br />line abutting a residential use or residentially designated property; <br />Note: The proposed addition will be located more than 30' from any property boundary. <br />b. Access shall be from a major thoroughfare unless otherwise approved by the Public <br />Works Department; <br />Note: No new access points are proposed. The site fronts a major thoroughfare roadway, and <br />the existing access points were approved by the Public Works Department under previous <br />site plans. <br />C. Any accessory residential use, day care facility or school upon the premises shall <br />provide such additional lot area as required for such use by this section and shall <br />further be subject to all conditions set forth by the reviewing procedures and <br />standards for that particular use. Accessory residential uses may include convents, <br />monasteries, rectories or parsonages as required by these regulations; <br />Note: No accessory residential, day care, or school use is proposed. <br />d. A Type "C" buffer shall be provided along all property boundaries where the facility <br />is located adjacent to a single-family residentially zoned property. A Type "D" buffer <br />shall be provided along all property boundaries when the facility is located adjacent <br />to a multiple -family residentially zoned property or agriculturally zoned property <br />having a residential land use designation. <br />1. The Board of County Commissioners may waive or reduce the buffer <br />requirements where the place of worship is located next to an existing <br />cemetery, place of worship, child care facility, community center, or <br />school. Consideration shall be given to security, noise, and visual <br />impacts. Where a waiver or a buffer reduction is granted, normal <br />perimeter landscaping requirements shall apply, and alternative <br />requirements (such as fencing) may be required. <br />Note: The proposed facility fronts one site perimeter only; that perimeter being the Roseland <br />Road frontage of the project construction area. That construction area is separated from a <br />single-family zoned property (owned by the church) by Roseland Road, a thoroughfare plan <br />road. In accordance with landscape ordinance section 926.08(5), the separation provided by <br />Roseland Road reduces the buffer requirement from a Type "C" to a Type "D". The <br />proposed plan provides a Type "D buffer between the project construction area and <br />Roseland Road. Therefore, this specific land use criterion is satisfied. <br />Based on the above analysis, the proposed project satisfies all applicable places of worship specific <br />land use criteria. <br />14. Concurrency: The applicant has committed to obtaining a final concurrency certificate <br />prior to issuance of a building permit and has acknowledged all concurrency requirements. <br />Therefore, all concurrency requirements related to minor site plan and special exception use <br />approval have been satisfied. <br />SEPTEMBER 7, 1999 <br />72 <br />
