Street right-of-way is not paved and not needed for access to any properties. Access to lots to the <br />north and south of this segment of 11' Street right-of-way is from Commerce Avenue. <br />Although the county does not desire to use the right-of-way for road building purposes, the right-of- <br />way could still be used for future drainage and utility purposes. Therefore, the county Engineering <br />Division is recommending that a 30' wide drainage and utility easement be retained over the middle <br />30' portion of the 60' wide right-of-way segment. The easement will run east/west and will be <br />centered within the boundaries of the existing right-of-way. For that reason, the Resolution of <br />Abandonment expressly reserves a 30' wide drainage and utility easement. <br />Per guidelines established by the Board of County Commissioners, this petition was reviewed by all <br />county divisions and utility providers having jurisdiction or potential interests within the right-of- <br />way. All reviewing agencies and departments have recommended approval of the requested <br />abandonment, with the condition that a 30' wide easement for utilities and drainage be reserved The <br />subject right-of-way is not part of the roadway system as noted on the County Thoroughfare Plan, <br />and is not needed for the thoroughfare system. Furthermore, the abandonment would not affect the <br />right of convenient access to surrounding properties. Also, the County Attorney's Office has <br />reviewed and approved the attached abandonment resolution for legal form and sufficiency. <br />Based on the analysis, staff recommends that the Board of County Commissioners abandon its rights <br />to the subject right-of-way and authorize the chairman to execute the attached abandonment <br />resolution, with the following condition: <br />1. That a 30' wide drainage and utility easement be reserved and that the said easement is to be <br />created within the boundaries of the subject right-of-way and run in an east/west direction. <br />The Chairman opened the public hearing and asked if anyone wished to be heard in <br />this matter. There being none, the Chairman closed the public hearing. <br />ON MOTION by Commissioner Stanbridge, <br />SECONDED by Commissioner Ginn, the Board <br />unanimously adopted Resolution 99-107 providing <br />for the closing, abandonment, vacation and <br />discontinuance of a portion of 11' Street west of <br />Commerce Avenue and east of the FEC Railroad <br />between Lot 14, Block 2 and Lot 1, Block 3 in the <br />Rosedale Gardens Subdivision and reserving a 20' <br />drainage and utility easement centered in the <br />abandoned right-of-way. <br />SEPTEMBER 28, 1999 <br />40 0 <br />
