BOOK IJ <br />immediately north of the subject site, thereby providing the same function that the alley was <br />designed to provide. Thus, the proposed abandonment and new public driveway will result in a <br />westward "jog" of an actual, paved alleyway/public driveway that will connect 42' Street with 41° <br />street between US #1 and Old Dixie Highway. Prior to recording the abandonment, the applicant <br />will provide a public access easement to cover the proposed public driveway. In staffs opinion, <br />provision of the public north/south driveway should be a condition of approving the abandonment <br />Although the subject right-of-way has never been developed as an alley and the applicant's site plan <br />design provides an acceptable alternative for public vehicular circulation, the existing right-of-way <br />does contain some utilities. Therefore, the entire existing alley right -0f -way needs to be retained as <br />a drainage and utility easement For that reason, the proposed Resolution of Abandonment provides <br />for abandoning the subject right-of-way but expressly reserves a drainage and utility easement over <br />the entire right-of-way area <br />Per guidelines established by the Board of County Commissioners, this petition was reviewed by all <br />county divisions and utility providers having jurisdiction or potential interests within the right-of- <br />way. All reviewing agencies and departments have recommended approval of the requested <br />abandonment with the condition that the entire right-of-way be retained as a drainage and utility <br />easement The subject right-of-way is not part of the roadway system as noted on the County <br />Thoroughfare Plan, and is not needed for the thoroughfare system. Furthermore, the abandonment <br />would not affect the right of convenient access to surrounding properties, provided that the <br />referenced public driveway is established Also, the County Attorney's Office has reviewed and <br />approved the attached abandonment resolution for legal form and sufficiency. <br />Based on the analysis, staff recommends that the Board of County Commissioners abandon its rights <br />to the subject right-of-way and authorize the chairman to execute the attached abandonment <br />resolution, with the following conditions: <br />That the entire right-of-way be reserved as a drainage and utility easement, and <br />2. That prior to recording the resolution, the applicant shall provide a'recorded public <br />access easement for the proposed north/south driveway, in a form that is acceptable <br />to the County Attorney's Office. <br />Application <br />Location Map <br />Resolution <br />Planning Director Stan Boling reviewed the memorandum with the aid of the location <br />map (page 203 of the backup) and other maps (not in the backup) displayed. <br />Commissioner Adams understood this was being done simply to accommodate the <br />design of the station. <br />December 7, 1999 <br />72 <br />
