Ownership of bottomland, even if true, does not carry with it the <br />right to take away others' riparian rights. <br />9. Copy of Dedication from the Trustees of the Internal Improvement Fund of the State of <br />Florida indicating, not that the County owns the property, but that it is owned by the <br />Trustees and dedicated for public park and recreation purposes with a reverter clause if <br />not used for such purposes within three years from March 2, 1965. Round Island <br />Riverfront Park was created long ager 1968. <br />10. Letter dated November 18, 1996, from Harold Olson to James Davis indicating the <br />effect of the value of the waterfront properties whose only access to the waters of the <br />Intracoastal Waterway is by way of the channel between No Name Island and Round <br />Island Paris. <br />11. Query dated March 18, 1997, from the St. Johns River Water Management District to <br />James W. Davis seeking, in numbered paragraph 2, quantification of boat traffic and <br />warning thatthe height of the bridge "may need to be raised based upon the quantity and <br />type of boat traffic," all in connection with the County's pending application for permit <br />to construct the bridge. <br />12. Response dated April 10, 1997, to the preceding item, indicating boat count was taken <br />on April 8, 1997. This represented a count taken on one day of the year, a Tuesday, to <br />quantify boat traffic through the navigable channel. <br />13. Letter dated August 11, 1997, from St. Johns River Water Management District giving <br />consent to use state owned sovereignty submerged lands, based on the information <br />supplied by Indian River County. Attached are the conditions to the District's consent <br />to use of the bottom lands, reciting that the County acknowledges that the land is owned <br />by the Board of Trustees of the Internal Improvement Trust Fund and, as the last item, <br />DECEMBER 14, 1999 <br />-62- <br />
